These Terms & Conditions apply to services supplied by Jack Barnes, a sole trader trading as Barnes Analytics (“Barnes Analytics”, “we”, “us” or “our”).

Where documents conflict on a project-specific matter, the accepted quotation or Statement of Work will take priority.
2. Our Services
Barnes Analytics provides services including:
Power BI dashboard design and development;
data analytics and business intelligence reporting;
data preparation, cleaning and modelling;
bespoke calculations, KPIs and visualisations;
sports performance and operational reporting;
dashboard maintenance and support;
analytics consultancy;
half-day and full-day Power BI training; and
other related analytics services agreed in writing.
The exact service supplied is the service described on the relevant package page at the time of purchase or in your accepted quotation, booking confirmation or Statement of Work.
3. Dashboard Packages
Barnes Analytics may offer standard dashboard packages including:
Starter Dashboard
Professional Dashboard
Complete Dashboard
We may also provide bespoke dashboard and analytics projects.
The package description displayed at the time of purchase forms part of the agreed scope.
Package limits may include:
number of dashboard pages;
number of structured data sources;
level of data preparation;
calculations and KPIs;
visualisation complexity;
branding;
revision rounds;
handover duration;
estimated delivery period; and
post-delivery support.
Features shown within another package, portfolio project or demonstration dashboard are not automatically included within your purchase.
4. Services Outside the Standard Package Scope
Unless expressly included in your package, quotation or Statement of Work, the following are not normally included:
additional dashboard pages;
additional data sources beyond the agreed limit;
extensive reconstruction of unstructured or poor-quality data;
major manual data entry;
API development or integration;
database engineering;
automated data pipelines;
significant reconstruction of an existing data model;
Microsoft Power BI licences;
Microsoft 365 licences;
Power BI tenant administration;
gateway hosting;
ongoing cloud hosting or publication management;
ongoing development after an included support period; or
functionality materially different from the original brief.
We will not knowingly undertake additional chargeable work without first obtaining your agreement.
5. Data Sources and Data Preparation
For the purposes of a dashboard package, a data source means a distinct structured source, file, dataset or connection identified as part of the agreed project.
You are responsible for supplying reasonably complete and accurate source data.
Barnes Analytics will undertake the level of data cleaning, modelling and preparation included within the purchased package.
If the supplied data requires substantially more restructuring or remediation than could reasonably have been anticipated, we may:
explain the additional work required;
propose an amended scope;
provide a separate quotation; or
where appropriate, allow the project to be cancelled in accordance with our Cancellation & Refund Policy.
6. Client Responsibilities
You agree to:
provide accurate information about your requirements;
provide requested data, files, system access and branding;
respond to reasonable requests for feedback and approval;
ensure that you are authorised to provide data, logos, images and other materials supplied to Barnes Analytics;
ensure that personal information is supplied lawfully;
maintain any Microsoft or third-party licences required to use the finished solution unless expressly agreed otherwise;
review the accuracy of source data; and
review dashboard outputs before relying upon them operationally.
Project timescales may be extended where required data, access, information, feedback or approvals are delayed.
7. Dashboard Design, Analytics and Calculations
Barnes Analytics will use reasonable care and skill when developing:
calculations;
KPIs;
models;
benchmarks;
visualisations;
reports; and
dashboards.
Analytics are dependent upon the accuracy and completeness of the source data, definitions, assumptions and requirements provided.
Unless specifically included in the agreed scope, Barnes Analytics does not independently audit the truth or completeness of client data.
You remain responsible for confirming that dashboard outputs are suitable for your organisation before using them to make operational or professional decisions.
8. Sports Performance and Health-Related Analytics
Where Barnes Analytics provides services within sport, dashboards may include information relating to:
physical performance;
workload;
wellness;
testing;
availability;
injury;
rehabilitation; or
other athlete monitoring information.
These analytics are designed to support professional decision-making.
Dashboard outputs, flags, thresholds or classifications must not be treated as:
medical advice;
clinical diagnoses;
guarantees of injury risk;
guarantees of player availability;
treatment recommendations; or
automatic return-to-play decisions.
Appropriately qualified practitioners remain responsible for medical, clinical and return-to-play decisions.
Your original agreement specifically recognises that injury and wellness data may constitute special-category personal data and that dashboard outputs should not be treated as clinical diagnoses.
9. Revisions
A revision round means one consolidated set of reasonable amendments submitted after Barnes Analytics provides a version of the agreed deliverable for review.
A revision does not normally include:
an additional dashboard page;
an additional data source;
a material change to the original requirements;
substantial new functionality;
reconstruction of the underlying data model; or
work otherwise outside the agreed project scope.
Requests outside the included revision allowance may be treated as additional work and quoted separately.
10. Delivery Times
Estimated delivery periods begin once Barnes Analytics has received and agreed:
the project brief;
required source data;
required access;
required branding or assets; and
any payment required before work begins.
Unless expressly agreed as fixed in writing, delivery dates are estimates.
We will notify you if a material delay is expected.
Delays caused by late information, data, system access, feedback or approvals from the Client may result in the delivery date moving accordingly.
11. Online Orders and Project Acceptance
Placing an order or making payment through the Barnes Analytics website constitutes an offer to purchase the selected service.
For standard services requiring no further assessment, an order may be accepted through an order confirmation.
For bespoke dashboard or analytics development, an automated payment receipt does not necessarily mean that Barnes Analytics has accepted the project.
We may first review your requirements and supplied data.
If we reasonably determine that:
the requested work materially exceeds the purchased package;
the work cannot reasonably be completed using the supplied data or systems;
necessary information or access is unavailable;
the requested work falls outside the services we provide; or
carrying out the requested work would be unlawful,
we may decline the project.
Where appropriate, we will refund payments made for work that has not begun.
Alternatively, we may offer a revised quotation. You are under no obligation to accept that quotation.
12. Fees and Payment
The price payable is the price displayed at checkout or stated in your accepted quotation, booking confirmation or Statement of Work.
Payment stages and due dates will be confirmed before work begins where applicable.
Where Barnes Analytics is not VAT registered, VAT will not be added to the price.
We may pause work where an undisputed payment is overdue.
Where applicable to business customers, statutory rights relating to late commercial payments may also apply.
13. Completion, Acceptance and Handover
Once the agreed work and included revisions have been completed, Barnes Analytics will provide:
the agreed final deliverables; and
any handover session or documentation included in the package.
You should notify us promptly if a final deliverable materially differs from the agreed scope.
New preferences, enhancements or additional requirements raised after completion may constitute new work unless they fall within an included post-delivery support period.
14. Power BI Files, Licensing and Third-Party Services
Where your package includes a final Power BI .pbix file, it will be supplied once the relevant payment obligations have been met.
Unless expressly stated otherwise, Barnes Analytics does not provide:
Microsoft Power BI licences;
Microsoft 365 licences;
database licences;
third-party software subscriptions;
gateway infrastructure;
tenant administration; or
ongoing cloud hosting.
You are responsible for obtaining any licences necessary to use, publish or share the finished dashboard.
Microsoft and other third-party providers may change their products, licensing, pricing, functionality or availability.
Barnes Analytics is not responsible for outages, restrictions or changes caused by third-party platforms.
15. Intellectual Property
Following full payment, you may use the project-specific final deliverables supplied to you for your internal business or organisational purposes.
Where agreed and legally possible, bespoke report content created solely for your project may transfer to you following full payment.
Barnes Analytics retains ownership of pre-existing and reusable materials including:
methods;
templates;
generic calculations;
reporting frameworks;
code libraries;
development techniques;
visual design techniques;
know-how;
development tools; and
reusable components.
Third-party intellectual property remains subject to the terms imposed by the relevant owner.
16. Portfolio and Demonstration Projects
Barnes Analytics may display examples of dashboard design, analytics, reporting and data visualisation within its website, portfolio, social media and marketing.
Some portfolio projects are created specifically for demonstration purposes using:
synthetic data;
fictional data;
anonymised data; or
appropriate publicly available data.
Where a project is presented as a demonstration:
figures and results may be fictional;
organisations or teams may be fictional;
individuals may be fictional;
financial or performance information may be fictional;
the example does not imply that the organisation shown commissioned Barnes Analytics; and
the project should not be interpreted as representing actual commercial or sporting performance.
Portfolio examples demonstrate Barnes Analytics' capabilities and do not determine what is included within a purchased package.
For genuine client work, Barnes Analytics will not publish confidential information or identifiable client data without permission.
A real Client's name, logo, testimonial, identifiable dashboard screenshot or other identifiable project material will only be used in our portfolio or marketing with prior permission.
17. Confidentiality
Each party agrees to keep confidential information received from the other confidential and to use that information only for purposes connected with the agreed services.
This obligation continues after the project, training session or support arrangement ends.
Confidentiality obligations do not apply to information that:
is publicly available other than because of a breach;
was already lawfully known;
was independently developed; or
must be disclosed by law.
18. Personal Data and Data Protection
Both parties will comply with applicable UK data-protection law.
Where Barnes Analytics processes personal information solely on your instructions for the purpose of providing a dashboard or related service, you will normally act as the data controller and Barnes Analytics will act as the data processor.
A separate Data Processing Agreement may apply.
You must notify Barnes Analytics before providing data containing:
health information;
injury information;
wellness information;
biometric data;
genetic data;
children's data; or
other special-category or high-risk personal information.
Such information should not be supplied until the relevant processing has been agreed and appropriate data-protection arrangements are in place.
Dashboard Support Services
19. Eligibility for Dashboard Support
Barnes Analytics offers monthly dashboard support services.
Support packages are primarily intended for dashboards originally created by Barnes Analytics.
We may agree to support a dashboard created by another provider following an initial technical review.
Third-party dashboards may require separately charged:
onboarding;
documentation;
repair;
model restructuring; or
remediation work.
20. Dashboard Support Allowances
Our standard support allowances are:
Dashboard Support
Up to 60 minutes of support per billing month.
Target initial response within 2 working days.
Enhanced Support
Up to 2 hours of support per billing month.
Target initial response within 1 working day, together with the review and health-check features displayed within the package purchased.
Managed Analytics Support
Up to 4 hours of support and development per billing month.
Includes priority handling and the proactive review, meeting and development features displayed within the package purchased.
The exact package description shown at the time you subscribe forms part of your agreement.
21. How Support Time Is Calculated
Support time may include time reasonably spent:
diagnosing issues;
reviewing dashboard files;
reviewing data;
investigating calculations;
communicating about an issue;
implementing changes;
testing;
troubleshooting; and
attending included support calls.
Barnes Analytics may keep a reasonable record of support time used.
22. Unused Support Time
Unused support time expires at the end of each monthly billing period.
Unused time does not roll over or accumulate unless Barnes Analytics expressly agrees otherwise in writing.
23. Support Response Times
Any advertised response time is a target for an initial response, not a guaranteed resolution time.
Resolution may depend upon:
issue complexity;
availability of the Client;
access permissions;
source-system availability;
Microsoft services;
third-party providers;
licences; and
availability of required information.
24. Work Outside Support Scope
Unless expressly included within the package, monthly support does not normally include:
substantial new dashboard pages;
major dashboard redesigns;
substantial new data sources;
significant system migrations;
complex automation;
major data-model reconstruction; or
development exceeding the monthly support allowance.
We will obtain your agreement before carrying out additional chargeable work.
25. Support Subscription Billing
Support subscriptions are billed monthly at the price displayed or agreed when the subscription begins.
The recurring nature of the payment and billing frequency will be displayed before purchase.
Unless a minimum term is expressly agreed, subscriptions continue until cancelled.
26. Cancelling a Support Subscription
Unless otherwise expressly agreed, you may cancel your support subscription at any time.
You can cancel through any online cancellation facility provided by Barnes Analytics or by contacting:

Cancellation prevents the next recurring payment.
Unless applicable law requires otherwise, support will remain available until the end of the billing period already paid for.
We will operate subscriptions in accordance with applicable UK consumer law.
Power BI Training
27. Training Services
Barnes Analytics offers:
Half-Day Power BI Training
Full-Day Power BI Training
The training supplied will be described in your package or booking confirmation.
Training may be tailored according to:
attendee experience;
organisational needs;
existing reporting processes; and
agreed learning objectives.
Exact modules may vary provided the agreed learning objectives are reasonably covered.
28. Training Attendee Responsibilities
Unless otherwise agreed, the customer is responsible for ensuring attendees have:
suitable computers;
reliable internet access;
appropriate Power BI software;
required Microsoft accounts or licences; and
suitable access to any files required during training.
For onsite sessions, the customer should provide an appropriate training environment, display equipment and internet access unless agreed otherwise.
29. Client Data Used During Training
Where customer data is to be used during a training session, the customer must ensure that it is entitled to provide that information.
Synthetic or anonymised training data is preferred.
Special-category, confidential or live personal data should not be used in training exercises unless this has been specifically agreed in advance.
30. Training Materials
Slides, exercises, sample files, templates, demonstrations and other training materials supplied by Barnes Analytics are licensed to the paying customer and attendees for:
personal learning; and
internal organisational use.
Unless Barnes Analytics provides prior written permission, training materials may not be:
resold;
publicly distributed;
uploaded to a public training library;
repackaged as another commercial product; or
used to deliver competing commercial training.
31. Recording Training Sessions
Training sessions may not be audio or video recorded without prior written permission from Barnes Analytics.
If recording is agreed, appropriate privacy and data-protection arrangements may also be required.
32. Business Training Cancellation and Rescheduling
Unless different terms are confirmed in your booking, the following applies to business training bookings:
More than 14 calendar days before the session
Cancellation or one reschedule without a training cancellation fee.
Between 7 and 14 calendar days before the session
Up to 50% of the agreed training fee may be payable.
Fewer than 7 calendar days before the session
Up to 100% of the agreed training fee may be payable.
Unavoidable travel, venue or other costs already committed specifically for the booking may also be payable where those costs were agreed in advance.
Consumer statutory rights take priority over this commercial cancellation schedule.
This is the same recommended commercial structure contained within the Barnes Analytics training terms.
33. Trainer Cancellation
If Barnes Analytics cannot deliver a training session because of illness or another event outside our reasonable control, we will attempt to arrange a reasonable alternative date.
If we cannot provide a suitable alternative, any training fee paid for the cancelled session will be refunded.
Unless required by law, Barnes Analytics is not responsible for indirect losses such as lost working time or travel arrangements.
Cancellations and Consumer Rights
34. Cancellation and Refund Policy
Our separate Cancellation & Refund Policy forms part of these Terms & Conditions.
Nothing in these Terms removes rights that customers have under applicable consumer law.
35. Consumer Online Cancellation Period
If you are an individual purchasing services wholly or mainly outside your trade, business, craft or profession, you may qualify as a consumer.
For most distance service contracts, consumers generally have a 14-day cancellation period beginning after the contract is entered into.
You do not normally need to provide a reason for cancelling within that statutory period.
36. Starting Services During the Cancellation Period
You may request that Barnes Analytics begins supplying the service before the statutory cancellation period ends.
Where required, we will obtain your express request before beginning work.
If you request an early start and subsequently cancel before the service has been fully performed, you may be required to pay an appropriate proportion of the agreed price for services already supplied.
Where a service has been fully performed following the required request and acknowledgement, your statutory right to cancel may end.
37. Faulty or Misdescribed Services
Nothing in these Terms limits any rights you have where a service is:
not supplied with reasonable care and skill;
materially different from the agreed description; or
otherwise subject to a statutory remedy.
General Terms
38. Standard of Service
Barnes Analytics will provide services with reasonable care and skill.
We do not guarantee that a dashboard, analytics project, consultancy service or training session will produce a particular:
commercial result;
financial result;
sporting result;
operational result;
employment outcome; or
learning outcome.
39. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
fraud or fraudulent misrepresentation; or
death or personal injury caused by negligence.
If you are a consumer, your statutory rights are not affected.
For customers acting wholly or mainly for business purposes, subject to liabilities that cannot legally be excluded or limited:
neither party will normally be liable for indirect or consequential losses;
Barnes Analytics will not be responsible for losses resulting from inaccurate or incomplete source data supplied by the Client; and
Barnes Analytics' total aggregate liability arising from a particular project will not exceed the total fees paid or payable for that project unless a higher amount is required by law.
For higher-value, sensitive-data or high-risk projects, alternative liability terms may be agreed in the applicable Statement of Work.
This is the clause I would most strongly recommend having reviewed by a UK solicitor before you begin accepting larger commercial projects. Your original legal pack carries the same recommendation.
40. Third-Party Platforms
Barnes Analytics may use or work with third-party products and services including Microsoft Power BI, Microsoft 365, cloud providers, website platforms and other software.
We cannot guarantee the continued availability, functionality, pricing or compatibility of third-party services.
Support does not constitute a guarantee of third-party service uptime.
41. Events Outside Reasonable Control
Neither party will be responsible for delay caused by circumstances outside its reasonable control, provided reasonable steps are taken to minimise the impact.
Where a delay becomes substantial, we will discuss an appropriate revised timetable or cancellation arrangement.
42. Termination
Either party may terminate an agreement where the other commits a serious breach and fails to remedy that breach within a reasonable period after receiving written notice.
Business customers cancelling a project for convenience after work has started remain responsible for work reasonably completed and unavoidable agreed costs incurred up to cancellation.
Consumer statutory cancellation rights are not reduced by this clause.

If you are unhappy with a Barnes Analytics service, please contact:

your name;
organisation, where applicable;
order or project reference;
a summary of the issue; and
the outcome you are seeking.
We aim to acknowledge complaints within 2 working days.
Where reasonably possible, we aim to provide a substantive response within 10 working days.
Nothing in this complaints procedure limits statutory rights.
44. Changes to These Terms
Barnes Analytics may update these Terms to reflect changes to:
services;
website functionality;
business practices; or
applicable law.
The Terms applying to an existing project will normally be those accepted when the contract was formed unless a later change is agreed or otherwise legally permitted.
We will not use this provision to make an unfair material unilateral change to an existing consumer contract.
45. Entire Agreement
For business customers, these Terms together with the applicable:
order confirmation;
quotation;
Statement of Work;
service description; and
Data Processing Agreement, where applicable,
form the agreement between the parties concerning the relevant service.
Any project variation must be agreed in writing.
This clause does not exclude liability for fraud and does not override consumer rights.
46. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Business customers submit to the jurisdiction of the courts of England and Wales.
Consumers retain any mandatory rights available to them under applicable consumer law.

troubleshooting;
delivering consultancy; or
providing related services.
These datasets may sometimes contain personal information relating to employees, customers, athletes or other individuals.
Where Barnes Analytics processes personal data solely on the instructions of a client, the client will normally act as the data controller and Barnes Analytics as the data processor.
A separate Data Processing Agreement may apply.
4. Sensitive and Special-Category Data
Some sports analytics projects may contain information relating to:
health;
injury;
rehabilitation;
wellness;
biometric information; or
children and young people.
Clients must inform Barnes Analytics before supplying this type of information.
Special-category or other high-risk personal information should not be supplied until the purpose, lawful processing arrangements and appropriate safeguards have been agreed.
5. How We Use Personal Information
Barnes Analytics may use personal information to:
respond to enquiries;
prepare quotations and proposals;
process orders and payments;
provide purchased services;
communicate about projects;
provide customer and dashboard support;
organise and deliver training;
maintain business and accounting records;
manage contracts;
investigate complaints or disputes;
operate and secure the website;
improve services;
comply with legal obligations; and
send marketing communications where permitted.
6. Our Lawful Bases
Under UK data protection law, Barnes Analytics must have a lawful basis for processing personal information.
Depending on the circumstances, we may rely on:
Contract
Where processing is necessary to provide a service you have purchased or to take steps requested by you before entering into a contract.
Examples include preparing a quotation, processing an order and delivering a dashboard project.
Legal Obligation
Where information must be processed to comply with legal, tax, accounting or regulatory obligations.
Legitimate Interests
Where processing is reasonably necessary for the legitimate interests of operating Barnes Analytics and those interests are not overridden by your rights.

Consent
Where consent is appropriate, including certain marketing communications and non-essential website cookies.

7. Marketing
Barnes Analytics will not automatically add you to a marketing mailing list simply because you make an enquiry or purchase a service.

8. Who We May Share Information With
Barnes Analytics may use trusted third-party providers to operate the business and website.
These may include:
Squarespace, as website and commerce platform;
payment-processing providers;
email and cloud-storage providers;
Microsoft services used in connection with Power BI and business operations;
accounting or bookkeeping services;
professional advisers; and
other suppliers required to provide an agreed service.
Information will only be shared where reasonably necessary and subject to appropriate contractual and data-protection arrangements where required.
We may also disclose information where required by law.
Barnes Analytics does not sell personal information to third parties.
9. International Data Transfers
Some technology providers used by Barnes Analytics may process information outside the United Kingdom.
Where personal information is transferred internationally, Barnes Analytics will take reasonable steps to ensure appropriate legal safeguards are in place as required by UK data-protection law.
10. How Long We Keep Information
Barnes Analytics only keeps personal information for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, tax and contractual requirements.
As a general approach:
Enquiries which do not become projects: normally retained for up to 24 months.
Contracts, invoices and financial records: may normally be retained for up to 6 years where required for business, tax, contractual or legal purposes.
Client source datasets: normally deleted or returned within 30 days following completion of the project unless continued retention is required for an agreed support service, requested by the client or required by law.
Marketing information: retained until you unsubscribe or until Barnes Analytics determines that the information is no longer required.
Retention periods may vary where there is a legitimate legal, contractual or security reason to retain information for longer.
11. Data Security
Barnes Analytics takes reasonable technical and organisational measures to protect personal information.
Measures may include:
password-protected systems;
multi-factor authentication where available;
device security;
appropriate cloud-storage controls;
limiting access to information;
secure transfer methods where appropriate;
maintaining current software and security updates; and
deleting information when it is no longer required.
Live client datasets will not knowingly be used in public portfolio demonstrations.
Synthetic or anonymised data will normally be used for portfolio and demonstration projects.
12. Your Data Protection Rights
Depending on the circumstances, UK data-protection law may give you rights including the right to:
ask for access to your personal information;
ask for inaccurate information to be corrected;
ask for information to be deleted;
ask for processing to be restricted;
object to certain processing;
request transfer of certain information;
withdraw consent where processing relies upon consent; and
complain about how your personal information is handled.
Not every right applies in every circumstance.

This policy applies to services purchased from Jack Barnes trading as Barnes Analytics.
Different rules may apply depending on whether you are purchasing for business purposes or as a consumer.
1. Dashboard and Analytics Projects
Dashboard services may include:
Starter Dashboard;
Professional Dashboard;
Complete Dashboard; and
bespoke dashboard or analytics projects.
Where a business customer cancels before work has begun, Barnes Analytics will normally refund amounts paid, less any unavoidable project-specific costs that were expressly agreed in advance.
Where a business customer cancels after work has begun, the customer will be responsible for:
work reasonably completed up to cancellation; and
unavoidable costs specifically incurred for the project where agreed in advance.
Any remaining amount will be refunded or invoiced as appropriate.
Consumer statutory rights take priority over these commercial provisions.
2. Project Deposits
Where a dashboard or bespoke project is purchased using a deposit arrangement, the deposit forms part of the total project price.
Payment of a deposit does not remove any statutory consumer cancellation rights that apply.
For business customers, if the project is cancelled after work begins, the deposit may be applied against the value of work reasonably completed and any agreed unavoidable costs.
Any amount paid in excess of sums legitimately due will be refunded.
3. Consumer 14-Day Cancellation Period
If you are an individual purchasing a service wholly or mainly outside your trade, business, craft or profession, you may qualify as a consumer.
For online service contracts, consumers will normally have a 14-day cancellation period beginning after the contract is entered into.
You do not normally need to provide a reason for cancelling during this period.
UK distance-selling rules require online businesses to provide consumers with clear cancellation information and confirmation of the contract in a form they can retain.
4. Starting Work During the Cancellation Period
You may request that Barnes Analytics begins work before your statutory cancellation period ends.
Where required, Barnes Analytics will obtain your express request before beginning the service.
If you request an early start and subsequently cancel before the service is fully completed, you may be required to pay a proportionate amount for services already supplied.
Where the service has been fully performed following the required request and acknowledgement, your statutory right to cancel may end.

Barnes Analytics may offer recurring support packages including:

Managed Analytics SupportUnless a minimum term is expressly agreed, support subscriptions may be cancelled at any time.
Cancellation can be requested through any online cancellation facility provided or by contacting:

Cancellation prevents the next recurring payment.
Unless applicable law requires otherwise, your support entitlement will continue until the end of the period you have already paid for.
Unused monthly support time does not roll over.
6. Power BI Training — Business Bookings
Unless different cancellation terms are confirmed when booking:
More than 14 calendar days before the session
Cancellation or one reschedule without a training cancellation fee.
Between 7 and 14 calendar days before the session
Up to 50% of the training fee may be payable.
Fewer than 7 calendar days before the session
Up to 100% of the training fee may be payable.
Any unavoidable travel or venue costs already committed specifically for the booking may also be payable where agreed beforehand.
Consumer statutory rights take priority over these commercial terms.
7. If Barnes Analytics Cancels Training
If Barnes Analytics cannot deliver a training session because of illness or another event outside our reasonable control, we will offer a reasonable alternative date.
If a suitable alternative cannot be provided, any training fee paid for the cancelled session will be refunded.
8. Faulty or Misdescribed Services
Nothing in this policy affects statutory rights relating to services that:
are not provided with reasonable care and skill;
materially differ from the agreed description; or
otherwise give rise to a remedy under applicable consumer law.
Depending on the circumstances, remedies may include repeating or correcting the service, a price reduction or a refund.
